Finarte: Tout de Suite / Modern & Contemporary Art

In addition to Artsy’s General Terms and Conditions of Sale (“Artsy Terms”), the Finarte S.p.A. Conditions of Sale (“Finarte Terms”) apply to all bidders that register for and/or bid in the Finarte: Tout de Suite / Modern & Contemporary Art through Artsy, except as limited below. In the event of a conflict between the Artsy Terms and the applicable Finarte Terms, the Finarte Terms will prevail.

Finarte Terms Exclusions:
The following portions of the Finarte Terms are excluded in their entirety for Artsy bidders:
-Registration directly with Finarte: Including submission of a valid ID and tax code (Codice Fiscale).
-Telephone and written absentee bids: All references to telephone and written absentee bidding.
-Finarte’s own online bidding portal: All references to Finarte’s proprietary online bidding platform.

These sections are superseded by Artsy’s own bidder registration and online bidding process. You will be considered a “registered bidder” under the Finarte Terms once you have successfully completed --
Artsy’s registration procedures for the auction. You will not be required to register separately with Finarte to bid through Artsy. However, you may be required to complete some or all of Finarte’s post-sale onboarding or compliance procedures in order to complete your purchase if you place a winning bid.

Notes:
Please take note of the following terms:
-VAT: VAT may be applied to the Hammer Price and/or Buyer’s Premium, depending on the lot and applicable Italian law. Refer to Finarte’s catalogue symbols for VAT treatment.
-Artist’s Resale Right (Droit de Suite): Payable by the Buyer in accordance with Italian law for lots marked with the appropriate symbol. The maximum payable per lot is €12,500, and the right applies only if the selling price is not less than €3,000.
-Payment Methods
Payment must be made by cash (up to €4,999.99), bank draft, cheque, bank transfer, or authorized credit card (American Express, Visa, Mastercard).
All payments must be in euros. Equivalent amounts in other currencies are accepted only if calculated at the exchange rate on the day of payment.
Finarte reserves the right to verify the origin of payments and may reject payments from persons other than the Buyer. Payment is due immediately and no later than five (5) days after the auction.
-Shipping, Collection, and Storage
Buyers must arrange for collection within five (5) business days from the date of sale, only after full payment is received. If the Buyer fails to collect within this period, Finarte may charge storage fees or store the lot with a third party at the Buyer’s risk and expense.
Shipping must be arranged independently unless otherwise agreed.
-Condition and Authenticity
All lots are sold “as seen and liked,” with no warranty against hidden defects. Catalogue and condition report descriptions are for identification only and not guarantees of authenticity or condition.
In case of Counterfeit, Finarte may refund the Buyer under certain conditions, provided claims are made within five years of the sale and supported by two independent experts.
-Governing Law and Jurisdiction: Disputes shall be subject to the jurisdiction of the Courts of Milan (Section 17 of the Finarte Terms). For disputes involving Artsy, Section 26 of the Artsy Terms will apply.
